Appeal lodged against Cheshire East’s failure to determine Wybunbury housing plans

An appeal has been lodged against Cheshire East's failure to determine a planning application which was recently deferred for a site visit and was recommended to be approved in two days' time.

Martin and Simon Poole have applied for permission in principle (PIP) to build up to six homes on a field off Bridge Street at Wybunbury.

The application was considered by Cheshire East's southern planning committee on July 30 and deferred so councillors could visit the site to see what impact the development would have on the surrounding area.

It is due to be considered again on Wednesday 10 September 10, the first southern planning meeting since the deferral, and was recommended by the council's planning officers for approval.

The southern planning committee takes place at 10.30am on Wednesday 10 September at Crewe Municipal Buildings (Nub News).

But, an updated report on the agenda for this week's meeting says the decision has now been taken out of councillors' hands and will be made by a planning inspector at a later date because an appeal has been lodged.

The planning officer's report states: "We have now received notification that the applicant has lodged an appeal for the non-determination of this application, the statutory time limit for the determination of a permission in principle application is five weeks.

"The decision on this application will now be made by the planning inspectorate."

The report says, because of this, it is necessary to resolve how the committee would have determined this application if councillors had been able to do so.

"If the committee were minded to approve the application, then no appeal statement will be submitted by the council and the planning inspectorate will be advised of the council's position, other interested parties would still be able to express their views to the planning inspectorate," states the report.

"If the committee were minded to refuse the application, then an appeal statement will be submitted to the planning inspectorate."

The council's planners have now changed their recommendation from 'approve' to 'minded to approve'.

The southern planning committee takes place at 10.30am on Wednesday 10 September at Crewe Municipal Buildings.
